The regular meeting of the Buckingham Township Board of Supervisors was held April 28, 2010 in the Township Building, 4613 Hughesian Drive, Buckingham, Pennsylvania.

Mr. Forest called the regular meeting to order at 7:30 pm and led The Pledge of Allegiance.

PUBLIC COMMENT

There was no public comment.

 BOARD’S ANNOUNCEMENTS

Mr. Forest announced that Buckingham Township presents the following upcoming entertainment:

       -    “Up, Up and Away – Mad Science Show”, May 14th at 7pm, Buckingham Friends         Auditorium, free tickets are available at the township office.

       -    “Lecture in Song with Fred Miller”, May 21st at 7pm, Buckingham Springs Club House  on Route 413.

PAYROLL AND BILL LIST

Consideration of approving Payroll for the week ending April 25, 2010 and the Bill List for the meeting of April 28, 2010.

Mr. Forest made a motion, seconded by Mrs. Rash to approve Payroll for the week ending April 25, 2010 and the Bill List for the meeting of April 28, 2010. The motion carried with Mr. Forest and Mrs. Rash voting aye and Mr. Rowan voting nay.

MINUTES

Consideration of approving Supervisor's Minutes of the April 14, 2010 Work Session and April 14, 2010 Regular Business Meeting.

Mr. Forest made a motion, seconded by Mr. Rowan to approve the Supervisor’s Minutes of the April 14, 2010 Work Session and April 14, 2010 Regular Business Meeting, with the suggested revisions recommended by the township solicitor. The motion carried unanimously.

BUSINESS

1.  Consideration of accepting the Agreement to Extend the Residential Development Contract and Tripartite Escrow Agreement to May 9, 2011 from Thomas Verrichia on behalf of Buckingham Ridgeview L.P., for “Buckingham Ridgeview L.P. aka Verrichia Tract”,  Township File SA 2006-04.

Mr. Smith explained the township received an extension to May 26, 2010, which is when the current loan will expire.  Mr. Verrichia is trying to get his loan and therefore the Township letter of credit extended for another year. Mr. Smith recommended the Board grant authority to the Township Manager to call the escrow should the loan not be extended in sufficient time so that the Township’s ability to call the security is put at risk.

Mr. Forest made a motion, seconded by Mrs. Rash to grant township staff the authority to call the escrow due to the impending expiration of the security and because the project was not finished in a timely fashion. The motion carried unanimously.

2. Consideration of approving Resolution 2122, A Resolution of the Board of Supervisors of Buckingham  Township, County of Bucks, Commonwealth of Pennsylvania, Requesting a Grant from the Department of Conservation and Natural Resources to carry out the Park Plan Update and Master Plan for Holicong Park.

Mr. Forest made a motion, seconded by Mrs. Rash to approve Resolution 2122, A Resolution of the Board of Supervisors of Buckingham Township, County of Bucks, Commonwealth of Pennsylvania, Requesting a Grant from the Department of Conservation and Natural Resources to carry out the Park Plan Update and Master Plan for Holicong Park. The motion carried unanimously.

3. Consideration of awarding the 2010-2011 Fuel Bid to Superior Plus Energy Services (Sunoco Inc.) of Aston, PA, through the Bucks County Consortium.  

Mr. Forest made a motion, seconded by Mrs. Rash to award the 2010-2011 Fuel Bid to Superior Plus Energy Services (Sunoco Inc.) of Aston, PA, through the Bucks County Consortium.  The motion carried unanimously.

4. Consideration of awarding the 2010 Street Sweeping Contract to RMC Clean Sweep of Buckingham, PA.

Mr. Forest made a motion, seconded by Mrs. Rash to award the 2010 Street Sweeping Contract to RMC Clean Sweep of Buckingham, PA. The motion carried unanimously.

5. Request for Payment:

RGC Development – Furlong Well F-8, Water Main – Contract BT-09-01

Payment Request #1

$73,983.54

Signature Bridge, Inc. – Cold Spring Creamery Road, Timber Bridges -Contract No. 2009-02

Payment Request #4 – Final Payment

$17,768.50

Mr. Forest made a motion, seconded by Mrs. Rash to approve Payment Request #1 to RGC Development – Furlong Well F-8, Water Main – Contract BT-09-01, in the amount of $73,983.54 and to approve the Final Payment Request #4 to Signature Bridge, Inc. – Cold Spring Creamery Road, Timber Bridges – Contract No. 2009-02, in the amount of $17,768.50.  The motion carried unanimously.

6. Consideration of approving Change Orders #1 and #2 for the Furlong Well F-8, Water Main, BT-09-01 for a total contract increase of $9,555.00.

Mr. Forest made a motion, seconded by Mrs. Rash to approve Change Orders #1 and #2 for the Furlong Well F-8, Water Main, BT-09-01 for a total contract increase of $9,555.00. The motion carried unanimously.

7. Additional Business / Manager’s Items:

-  Consideration of appointing Patrick Houston to the Water and Sewer Commission to fill a vacancy with a term expiring January 1, 2012.

Mr. Forest made a motion, seconded by Mrs. Rash to appoint Patrick Houston to the Water and Sewer Commission to fill a vacancy with a term expiring January 1, 2012. The motion carried unanimously.

- Consideration of approving Peddler’s Village 2010 “Celebration of Freedom” special event and gathering permit, including a pyrotechnic display, and consideration of waiving the permit fee.

Ms. Cozza explained that the permit fee of $2,000.00 is for review and processing of the application, but that after many years of this event there is not as much time spent on this application. A discussion ensued concerning what the actual cost to the Township was and it was decided it was now about one-half of the permit fee, given the repetitive nature of the application. Mr. Forest stated it was nice that Peddler’s Village provides the fireworks display for the local township residents to enjoy.

Mr. Forest made a motion, seconded by Mrs. Rash to reduce the permit fee for the peddler’s Village 2010 “Celebration of Freedom” by 50% to $1,000.00. The motion carried unanimously.

Mr. Forest made a motion, seconded by Mrs. Rash, to grant the special event and gathering permit for the Peddler’s Village 2010 “Celebration of Freedom” including a pyrotechnic display. The motion carried unanimously.

- Consideration of approving the Request for a Waiver of Land Development as submitted by Gilmore & Associates, Inc. on behalf of Reed Road Associates, L.P., 739 N. Easton Road, TMP 6-2-5.

Mr. Forest made a motion, seconded by Mrs. Rash to approve the Request for a Waiver of Land Development as submitted by Gilmore & Associates, Inc. on behalf of Reed Road Associates, L.P., 739 N. Easton Road, TMP 6-2-5 conditioned upon the plans being acceptable to the Township Engineer. The motion carried unanimously.

- Consideration of approving the Shut Off Agreement between Bucks County Water & Sewer Authority and Buckingham Township.

Mr. Forest made a motion, seconded by Mrs. Rash to approve the Shut Off Agreement between Bucks County Water & Sewer Authority and Buckingham Township, and authorizing the appropriate township officials to sign the agreement on behalf of Buckingham Township. The motion carried unanimously.

Mr. Forest made a motion, seconded by Mrs. Rash to adjourn the meeting at 7:56pm.  The motion carried unanimously.
