Meeting Minutes
The regular meeting of the Buckingham Township Board of Supervisors was held May 12, 2010 in the Township Building, 4613 Hughesian Drive, Buckingham, Pennsylvania.

Mr. Forest called the regular meeting to order at 7:35 pm and led The Pledge of Allegiance.
PUBLIC COMMENT
Mr. John Cunningham, Carversville Road, expressed concern about the signs placed at the intersection of Route 413 and Route 263 making it illegal for pedestrians to cross the street. Mr. Gray explained that it was a PennDOT condition of the traffic permit and highway occupancy permit that the signs be placed there. Mr. Cunningham asked the Township to address the issue with PennDOT. Solicitor Smith explained that the intersection was not under the Township’s jurisdiction and recommended that Mr. Cunningham direct his complaint to PennDOT. Mr. Forest asked Ms. Cozza to get Mr. Cunningham some contact numbers for PennDOT.
BOARD’S ANNOUNCEMENTS
Mr. Forest made the following announcement:
- Election Day – Tuesday, May 18, 2010
- The Board of Supervisors Work Session of May 19, 2010 has been cancelled.
- Buckingham Township presents the following upcoming entertainment:
“Up, Up and Away – Mad Science Show”, May 14th at 7pm, Buckingham Friends Auditorium, free tickets are available at the township office.
“Lecture in Song with Fred Miller”, May 21st at 7pm, Buckingham Springs Club House on Route 413.
PAYROLL AND BILL LIST
Consideration of approving Payroll for the week ending May 9, 2010 and the Bill List for the meeting of May 12, 2010.
Mr. Forest made a motion, seconded by Mrs. Rash to approve Payroll for the week ending May 9, 2010 and the Bill List for the meeting of May 12, 2010. The motion carried unanimously.
MINUTES
Consideration of approving Supervisor's Minutes of the April 28, 2010 Work Session and April 28, 2010 Regular Business Meeting.
Mr. Forest made a motion, seconded by Mr. Rowan to approve the Supervisor’s Minutes of the April 28, 2010 Work Session and the April 28, 2010 Regular Business Meeting. Solicitor Smith summarized his changes: in the work session he corrected the spelling of Crohn’s disease and in the regular business meeting in the Verrichia discussion he clarified that should the escrow agreement not be renewed in time prior to its May 26, 2010 stated expiration, then Township staff is directed to call the security, but if it is renewed in time, then the Township staff has discretion not to call the security. The motion carried unanimously.
Consideration of accepting various Departmental Minutes and Advisory Body Minutes.
Mr. Forest made a motion, seconded by Mrs. Rash to accept the various Departmental Minutes and Advisory Body Minutes. The motion carried unanimously.
BUSINESS
1. Consideration of accepting the Agreement to Extend the Residential Development Contract to June 11, 2011 for the “Gash Tract” Subdivision, Township File SA 2004-04.
Mr. Forest made a motion, seconded by Mrs. Rash to accept the Agreement to Extend the Residential Development Contract to June 11, 2011 for the “Gash Tract” Subdivision, Township File SA 2004-04. The motion carried unanimously.
ADDITIONAL BUSINESS / MANAGER’S ITEMS
1. Consideration of Utilizing the Tax Collection Committee for Collection of the Earned Income Tax in 2011.
Ms. Cozza explained that the Township was mandated by state law to start using the county wide Tax Collection Committee in 2012 but that there was an option to start using them in 2011. Board consensus was to wait and see the rate and which firm would be doing the tax collecting and then decide by which option cost the Township the least.
2. CB East appeal.
Mr. Forest made a motion, seconded by Mr. Rowan to direct Solicitor Smith to move forward on the stipulated settlement between the Central Bucks School District, the Bretzes, the Stadium Committee and the Township concerning the Bretz’ appeal of the Science and Technology Center land development and zoning approvals. The motion carried unanimously.
3. Conservation Easement on Hagan
Solicitor Smith asked for authority to proceed with an equity action to enforce the conservation easement owned by the Township on Tax Map Parcel No. 06-017-061 owned by Sugar Bottom Farms, LLC . Mrs. Rash made a motion, seconded by Mr. Forest to authorize Solicitor Smith to move forward with litigation to enforce the conservation easement. The motion carried unanimously.
Mr. Forest made a motion, seconded by Mrs. Rash to adjourn the meeting at 7:50pm. The motion carried unanimously.
