The work session of the Buckingham Township Board of Supervisors was held June 23, 2010 in the Township Building, 4613 Hughesian Drive, Buckingham, Pennsylvania

The meeting was called to order at 6:30 p.m.

1.  Executive Session

7:00 p.m. Dan Gray arrived

2.  Stoneridge / Foxbriar, Township File SA 91-09

Ms. Cozza explained the Residential Development Contract for Stoneridge/Foxbriar Subdivision will expire June 30, 2010 and the security will expire in September.  She explained the only reason this subdivision is not dedicated is due to its connection to the Peddler’s Village water system, and corresponding issues. DeLuca does not want to renew the Residential Development Contract.

Mr. Rowan asked what is DeLuca’s obligation for water. Mr. Smith explained they need to turn over necessary easements and property to the township, which they are more than willing to do. Mr. Rowan asked if there were any obligations in terms of the cost of the well. Mr. Smith replied no, all obligations are by Peddler’s Village. Mr. Rowan asked if the projects were interrelated. Mr. Smith explained the agreement was that Peddlers Village was to pay the township about $17,000 as a capital reserve for the well and its related facilities, and turn the well over to the township. Mr. Kelso agreed, and said there are no known issues with the water system. Mr. Rowan pointed out the water system is now twelve years old, and we have no idea of maintenance performed on it. Mr. Kelso said part of the $17,000 was meant to deal with any issues. Mr. Smith said the decision is would the township be better off collecting water rent and taking over the system, than not to.

Mr. Kelso mentioned the transfer agreement contemplated a bulk sales agreement, with one customer using 80% of the water. Mr. Smith said an agreement was executed 10 years ago laying all the details out.

Mr. Gray reported the outstanding issues for dedication of the water system are linked to the “Giggleberry” Land Development and are submittal of current as-builts, backfill necessary in certain areas and repainting cross walks. Peddler’s Village was notified of these items 1-1/2 years ago. Mr. Smith said it does not seem that Peddler’s Village is willing to spend money on revised as-builts.

Mr. Gray said that Peddler’s Village simply eliminated items they felt were unimportant on the as-built plans, such as the cross-walks and curb returns.  Mr. Rowan asked if there is enough detail to find important items. Mr. Gray said yes. Mr. Forest said he is fine with the as-builts as is.

Mr. Smith confirmed that if we reach an agreement with Peddler’s Village on the water, the Board would not require revised as-builts. The Board agreed and felt if Peddler’s Village was asked to re-paint the crosswalks, they probably would.

3.  HARB

Ms. Cozza explained the township received a letter from Wrightstown Township, expressing interest in forming a joint HARB for Wycombe Village. She asked if the Board would like an ordinance to be prepared adding the villages of Forest Grove, Holicong and Mechanicsville into the Spring Valley HARB ordinance, and prepare an individual ordinance concerning Wycombe.

Mrs. Rash would like this to be done, and wants to be sure that the residents are informed of the pending ordinance. Ms. Cozza said the draft ordinance could be posted on the township website, letters could be sent to the property owners in the Historic Districts letting them know the ordinance would be on an agenda, and a copy would be available at the township office.  The Board agreed to authorize Mr. Smith to prepare and advertise the ordinance during the regular business meeting.

4.  Verrichia Tract, Township File SA 2006-04

Mr. Smith summarized to the Board the request on hand is rather than pursuant to the existing call have the bank turn over/pay the development security on 6/28/10, Mr. Verrichia has requested to extend the date by which the bank had to pay the security pursuant to the call to 7/26/10, with the intention of being able to have Wilmington Trust provide an extension of the security agreement to 9/30/11 prior to that deadline.

Mr. Verrichia was present.   Mr. Rowan asked Mr. Verrichia when he expected the security issue to be resolved. Mr. Verrichia said he has done everything he can, it is in the bank’s hands.

Mr. Smith clarified the township had extended payment pursuant to the call to 6/28/10, and the Board could extend the obligation to produce money pursuant to the call to 7/27/10, with Wilmington Trust to confirm this information by the end of the business day on 6/28/10.  If security is settled and a new agreement is in place to 9/30/11, he proposed that the staff be authorized to withdraw the call.

Mr. Verrichia explained the agreement extension to 9/30/11 previously provided has been rescinded by Wilmington Trust, as it was signed and provided in error.

The Board had no problem extending the date by which the security had to be paid pursuant to the call to 7/26/10. Mr. Smith said this item needs to be acted on during the public meeting, and reiterated Ms. Cozza will issue a letter to Mr. Barrett of Wilmington Trust asking him to acknowledge the banks obligation by end of day 6/28/10.

5.  Conservation Easement Amendment, TMP 6-18-37

Mr. Smith explained the amendment on tonight’s regular meeting agenda for the “Allison Farm (Black)”. One lot of 19 acres will be permitted on a 4-acre curtilege, rather than the two, two acre lots permitted by the present easement. 

The Work Session was adjourned at 7:30 p.m.
