Meeting Minutes

The Regular meeting of the Buckingham Township Board of Supervisors was held June 23, 2010 in the Township Building, 4613 Hughesian Drive, Buckingham, Pennsylvania

Present:

Mr. Forest called the regular meeting to order at 7:30 pm and led The Pledge of Allegiance. 

PUBLIC COMMENT

No comment was offered.

BOARD’S ANNOUNCEMENTS

Mr. Forest made the following announcements:

   -       Family Concerts at Hansell Park Every Thursday evening from 7-9 p.m., starting June 24th  and Free Summer Fun for Kids. Check the township website at www.buckinghampa.org for details!

-          Bucks County’s Household Hazardous Waste and Old Computer Collection for the Middle Bucks Area will be July 10, 2010 at the CB South High School located at 1100 Folly Road in Warrington Township. 

PAYROLL AND BILL LIST

Consideration of approving Payroll for the week ending June 20, 2010 and the Bill List for the meeting of June 23, 2010.

Mr. Forest made a motion, seconded by Mrs. Rash to approve payroll for the week ending June 20, 2010 and the Bill List for the meeting of June 23, 2010.  The motion carried with Mr. Forest and Mrs. Rash voting aye and Mr. Rowan voting nay.

MINUTES

Consideration of approving Supervisor's Minutes of the June 9, 2010 Work Session and June 9, 2010 Regular Business Meeting.

Mr. Forest made a motion, seconded by Mrs. Rash to approve the Supervisor’s Minutes of the June 9, 2010 Work Session and June 9, 2010 Regular Business meeting. The motion carried unanimously.

BUSINESS

 1. Consideration of accepting the Agreement to Extend the Residential Development Contract and Tripartite Escrow Agreement to September 30, 2011 from Thomas Verrichia on behalf of Buckingham Ridgeview L.P., for “Buckingham Ridgeview L.P. aka Verrichia Tract”,  Township File SA 2006-04.

Mr. Forest made a motion, seconded by Mr. Rowan to authorize township staff to correspond with Wilmington Trust and advise them the previous security call remains outstanding and funds under that call must be turned over to Buckingham Township by the close of business on July 27, 2010 and if before that time the Township receives an extension to or about September 30, 2011 of a tripartite agreement providing the Township security, the Township would accept that extension and authorize the Township staff to withdraw the call, provided that Wilmington Trust acknowledges and accepts this revised date of July 27, 2010 by providing their written acknowledgment to Buckingham Township by 4:30 pm on June 28, 2010.  The motion carried unanimously.

 2.  Consideration of accepting the Agreement to Extend the Residential Development Contract to July 1, 2011 for the “Hawk Farm” Subdivision, Township File SA 98-07.  

Mr. Forest made a motion, seconded by Mrs. Rash to accept the Agreement to Extend the Residential Development Contract to July 1, 2011 for the “Hawk Farm” Subdivision, Township File SA 98-07.   The motion carried unanimously.

3.  Consideration of approving Resolution 2123, Approving the PennDOT Maintenance Agreements for the Cold Spring Creamery Road Pedestrian Crossings.

Mr. Forest made a motion, seconded by Mrs. Rash to approve Resolution 2123, Approving the PennDOT Maintenance Agreements for the Cold Spring Creamery Road Pedestrian Crossings.  The motion carried unanimously.

6.  Consideration of re-approving “Allison Farm”, Township File SA 2009-02, due to the previous approval being over 90 days ago, in order that Record Plans may be signed; and,

       Consideration of accepting the following items for “Allison Farm”, Township File SA 2009-02:

            Residential Development Agreement,

            Deed of Easement – Stormwater Management,

            Deed of Easement – Development Area / Stormwater Management Access,

            Deed of Dedication – Ultimate Right of way Easement of Forest Grove Road; and 

       Consideration of approving the Amendment to the Agricultural Preservation Easement in Favor of  Buckingham Township and the County of Bucks for TMP #6-18-37.

Mr. Forest made a motion, seconded by Mrs. Rash to re-approve “Allison Farm”, Township File SA 2009-02, due to the previous  approval being over 90 days ago, in order that Record Plans may be signed, approve the Residential Development Agreement accept the, Deed of Easement – Stormwater Management, Deed of Easement – Development Area / Stormwater Management Access, and Deed of Dedication – Ultimate Right of way Easement of Forest Grove Road; and to approve the Amendment to the Agricultural Preservation Easement in Favor of  Buckingham Township and the County of Bucks for TMP #6-18-37.  The motion carried unanimously.

7.  Additional Business / Manager’s Items:

            - Consideration of authorizing the preparation and advertising of the Bid for Liquid Sludge Removal.            

Mr. Forest made a motion, seconded by Mrs. Rash to authorize township staff to prepare and advertise the Bid for Liquid Sludge Removal. The motion carried unanimously.

          - Consideration of accepting the Lease for the Wastewater Water Treatment Plant property, TMP #6-10-228-7 and 6-10-228-8, between the Hughesian Free School Trust, Central Bucks School District and Buckingham Township.

Mr. Forest made a motion, seconded by Mrs. Rash to accept the Lease for the Wastewater Water Treatment Plant property, TMP #6-10-228-7 and 6-10-228-8, between the Hughesian Free School Trust, Central Bucks School District and Buckingham Township. The motion carried unanimously.

            - Consideration to authorize Township Solicitor to advertise the HARB Ordinance.

Mr. Forest made a motion, seconded by Mrs. Rash to authorize the Township Solicitor to advertise the HARB Ordinance. The motion carried unanimously.

8.  PUBLIC HEARING:  “American Towers, Inc. for the Use and Benefit of MetroPCS Pennsylvania, LLC and Cricket Communications, Inc.”, Township File CU 2010-01, 4776 Lower Mountain Road, TMP 6-18-152, AG-1 Zoning District, with a 60-day review period expiration date of July 12, 2010.

Mr. Forest opened the Public Hearing at 8:00 p.m.

A court stenographer was present.

Mr. Smith announced the hearing will be continued on July 14, 2010 in the Buckingham Township building at 8:00 p.m.  The record will be held open for receipt of specific documents discussed during the hearing. Upon receipt of the requested exhibits, the record will be closed, the Board of Supervisors will consider the application and render a verbal decision. Thereafter, in accordance with the requirements of the Municipal Planning Code, a written decision will be rendered.

Mr. Forest closed the Public Hearing at 9:39 p.m.

Mr. Forest made a motion, seconded by Mrs. Rash to adjourn the meeting at 9:40 p.m.  The motion carried unanimously.
